Walker served in the U.S. Army Air Force, 1943 to 1945, as a four-engine airplane pilot and flight instructor. The VA Regional Office denied his 2007 disability claim for bilateral hearing loss. Walker appealed to the Board of Veterans Appeals, including sworn statements from his son and wife that his hearing loss began in service and continued throughout his life. Walker was examined by a VA audiologist. Walker’s service medical records were not available due to a fire. The audiologist concluded that the hearing loss was “less likely as not caused primarily by military service as a pilot,” that age could not be excluded as the primary etiology, and that Walker was exposed to recreational noise by hunting game without use of hearing protection. The Board concluded that Walker failed under the three-element test to establish service connection for his hearing loss. The Federal Circuit affirmed. View "Walker v. Shinseki" on Justia Law

Viegas served in the U.S. Army, 1965-1967. After leaving the service, he was injured in a diving accident, resulting in “incomplete” quadriplegia. In 2004, Viegas participated in a prescribed aquatic therapy session at a VA medical center. He used a restroom in the VA facility. The grab bar he used to lift himself into his wheelchair came loose from the wall and he fell to the ground. As a result of the fall, Viegas sustained injuries to his upper and lower extremities. Viegas’ medical condition deteriorated after his fall. Prior to his fall, Viegas could sometimes walk with a walker, but since the accident he can only stand with assistance. Viegas sought disability benefits under 38 U.S.C. 1151. A VA regional office denied the claim. The board affirmed, stating that such benefits are available only if additional disability results from injury that was part of the natural sequence of cause and effect flowing directly from the actual provision of hospital care, medical or surgical treatment, or examination furnished by the VA and such additional disability was directly caused by that VA activity. The Veterans Court affirmed. The Federal Circuit reversed, holding that the Veterans Court misinterpreted the causation requirement. View "Viegas v. Shinseki" on Justia Law

A VA regional office awarded King disability compensation for residuals of a left knee surgery and right knee arthritis. King later sought disability compensation for disabilities of the back and hips on a direct basis and as secondary to his service-connected knee disabilities. Records revealed no treatment for back or hip problems during King's active duty service 1973-1974. King underwent a VA spine examination in 2000. The examiner diagnosed minimal degenerative joint disease of both hips and lumbosacral spine, related to age. A private physician disagreed. In 2007, the Board of Veterans denied King's appeal. The Veterans Court remanded. Additional evidence was developed and, in 2008, the Board obtained an opinion from a Veterans Hospital Administration orthopedist that it was not likely that King’s back and bilateral hip disabilities were directly caused or permanently worsened by the service-connected knee disabilities. The Board and Court of Appeals for Veterans Claims affirmed the denial. The Federal Circuit affirmed, rejecting an argument that the Veterans Court erred by discounting lay testimony offered by King and his wife. The Veterans Court did not fail to consider the proffered lay evidence, so King’s appeal was merely a challenge to the weight given his evidence.View "King v. Shinseki" on Justia Law

Ruppel sued CBS in Illinois alleging CBS’s predecessor, Westinghouse, caused the mesothelioma from which he suffers. Westinghouse had included asbestos in the turbines it supplied to the U.S. Navy, and Ruppel was allegedly exposed to it during his Naval service and later when he worked on an aircraft carrier as a civilian. CBS removed the case under the federal officer removal statute, which permits removal of certain suits where a defendant that acted under a federal officer has a colorable federal defense, 28 U.S.C. 1442(a)(1). Ruppel moved to remand and, without allowing response, the district court granted the motion. The district court concluded Ruppel only sued CBS for failing to warn about the dangers of asbestos for which there is no federal defense. The Seventh Circuit reversed. CBS’s relationship with Ruppel arises solely out of CBS’s duties to the Navy. It also has a colorable argument for the government contractor defense, which immunizes government contractors when they supply products with specifications approved by the government. American citizen-civilians, employees of a private Iraqi security services company, alleged that they were detained and tortured by U.S. military personnel while in Iraq in 2006, then released without being charged with a crime. Plaintiffs sought damages and to recover seized personal property. The district court denied motions to dismiss. In 2011, the Seventh Circuit affirmed in part, holding that plaintiffs sufficiently alleged Secretary Rumsfeld's personal responsibility and that he is not entitled to qualified immunity. On rehearing en banc, the Seventh Circuit reversed, stating that a common-law claim for damages should not be created. The Supreme Court has never created or even favorably mentioned a nonstatutory right of action for damages on account of conduct that occurred outside of the U.S. The Military Claims Act and the Foreign Claims Act indicate that Congress has decided that compensation should come from the Treasury rather than from federal employees and that plaintiffs do not need a common-law damages remedy in order to achieve some recompense. Even such a remedy existed, Rumsfeld could not be held liable. He did not arrest plaintiffs, hold them incommunicado, refuse to speak with the FBI, subject them to loud noises, or threaten them while they wore hoods. View "Vance v. Rumsfeld" on Justia Law

Petitioner served in the Army for about 30 months, 1981-1983 and suffered injury to her knees and wrist. The VA regional office assigned a 10 percent rating to her left wrist with an effective date of 1986. In 1987, her right arm was injured as a result of medical care she received from the VA. In 1990, her injury to right knee and shoulder were each rated at 20 percent and her left knee at 30 percent. In 1996, she was unable to continue working as a bookkeeper and brought a claim for total disability based on individual unemployability. The regional office rated her service-connected disabilities at 70 percent, but denied a total rating based on unemployability under 38 C.F.R. 4.16(a). The regional office and Board of Veterans’ Appeals rejected her 2004 application for review. The Secretary conceded that the regional office committed error by incorrectly computing petitioner’s rating. The Veterans Court found no “clear and unmistakeable error” and that the error was harmless because the RO had made an unemployability determination that satisfied the requirements for a 4.16(a) analysis. The veteran served in Vietnam in the 1960s. He was honorably discharged and received service connection compensation for arthritis and hearing loss. In 1993, he had a malignant melanoma surgically removed; it continued to spread and he died in 1994. The surviving widow filed an Application for Dependency and Indemnity Compensation alleging that her husband’s death was service connected due to exposure to Agent Orange and extensive sunlight while serving in Vietnam. The Regional Office denied the claim. In 2004, she filed the current claim and submitted an internet article discussing an Air Force study that found an elevated risk of melanoma in veterans who were exposed to Agent Orange. The Board reopened and remanded the claim. On remand, a VA medical examiner determined that it was "at least as likely as not" that the melanoma was causally related to active duty service. The RO again denied the claim.. The Board affirmed. The Veterans Court vacated and remanded. More than 7,000 named plaintiffs brought suit under the Federal Tort Claims Act, 28 U.S.C. 1346(b), 2671-2680, asserting injuries because of the U.S. Navy's alleged negligence in emitting pollutants during military exercises (which ended in 2003) at the Atlantic Fleet Weapons Training Facility on Vieques Island, Puerto Rico. The district court dismissed with prejudice for lack of jurisdiction. The First Circuit affirmed. The limited abrogation of sovereign immunity in the FTCA does not extend to these claims because of the discretionary function exception, which precludes FTCA actions against government conduct which is both within the discretion of the relevant government party and susceptible to policy-related judgments. The court rejected arguments that the Navy acted beyond its discretion because it allegedly violated mandatory directives concerning water pollution issued pursuant to the Clean Water Act, 33 U.S.C. 1251-1389; violated a pair of permits that purportedly forbid firing depleted uranium bullets on Vieques; violated unidentified internal regulations, policies, directives, and orders; and failed to comply with a purported duty to warn. This interlocutory appeal arose out of the deaths of two civilian drivers in a United States military supply-truck convoy in Iraq when insurgents attacked in April 2004. State tort claims were brought by or on behalf of spouses and family members of the decedents against KBR. KBR contended that the district court erred in denying its motion to dismiss and motion for summary judgment in which it argued that the Defense Base Act (DBA), 42 U.S.C. 1651-54, provided plaintiffs exclusive remedy and preempted all state tort claims that have been asserted. The court concluded that the DBR preempted plaintiffs' state law claims and therefore did not consider whether it had jurisdiction to entertain the alternative grounds on which KBR sought dismissal. After his unsuccessful cataract surgery, plaintiff brought a claim for battery against the United States government and his United States Navy surgeon. The United States invoked the Gonzalez Act, 10 U.S.C. 1089, immunizing individual military medical personnel from malpractice liability. At issue was whether section 1089(e) waived the government's sovereign immunity for common law battery claims. The court held that it did not and affirmed the district court's dismissal of plaintiff's complaint for lack of subject-matter jurisdiction. The court did not address plaintiff's remaining claims.
